In the indictment prepared by the Istanbul Chief Public Prosecutor’s Office, it was stated that on the morning of July 27th in Şişli, a 2-year-old baby named Seyfcan was brought to the city hospital as a result of violence, and the treatment of the victim in the hospital was started. In the indictment, which stated that the victim child was taken under protection, and an investigation was started regarding the father Delil İbrahim and Asmaa Serhane, who lived in the same house. In the indictment, it was claimed that the defendants beat the child named Seyfcan İbrahim, harmed the child’s body by putting out cigarette, thus committing the crime of ‘torment’. In the Forensic Medicine Institute report that came during the investigation suggested that it was not possible to distinguish the wounds medically; the wounds caused by putting out a cigarette were seen especially on the legs, the wounds on the back, neck and face were due to blunt trauma, and the wounds behind the right ear were caused by a sharp instrument, the injury in the left nail may be due to possible nail retraction. In the indictment, it is requested that the defendants Delil İbrahim and Asmaa Serhane be sentenced to a total of 4 years to 12 years in prison on charges of Torment and Injury.
The decision about the father who put out a cigarette on his child brought the court and the ministry against each other. The release of Syrian Delil İbrahim, who was on trial for 12 years and 6 months in prison for allegedly torturing a two-year-old baby named Seyfcan in Şişli by putting out a cigarette and beating her, was decided to be released.
It was stated that it was not certain that the lesions in the baby were caused by cigarette burns in the forensic medicine report. The lawyer of the Ministry of Family and Social Services reacted to the Forensic Medicine report. The detained defendant Delil İbrahim attended the hearing at the Istanbul 17th Criminal Court of First Instance via Audio and Video Information System (SEGBİS). Asmaa Serhane, who had a warrant for her arrest, did not attend the hearing.
FORENSIC REPORT REACHED THE COURT
The judge stated that the report prepared as a result of the examination of the child by being brought to the Forensic Medicine Institute Branch Directorate between the hearings reached the file.
In the report dated October 13th, it was stated that it cannot be said with certainty that the lesions were formed as a result of cigarette burns, that the child had new lesions in millimeters showing swelling on the skin, and considering that the child was in the act of scratching these lesions, the lesions in question may also have occurred due to non-traumatic reasons.
A lawyer from the Ministry of Family and Social Services talked on the situation:
“The report is inconsistent with the facts as time has passed. As can be understood from the video recordings submitted to the file, the injury to the victim consisted of cigarette burns. We want this matter to be taken into account and the accused to be punished.”
“I HAVE TAKEN CARE OF THE BABY SINCE HIS MOTHER LEFT.”
Defendant Delil İbrahim, in her defense through the translator, said:
“Since his mother left, I have dressed the child, fed him and made him drink. I took care of him. I love my child very much. It is not possible for a person to do such a thing to his own child. My only mistake was taking other people into the house. They also do not attend the hearing. This shows that they are guilty. I do not accept the accusations. I demand my acquittal and release.”
The court committee take , the defense of the accused due to the possibility of changing the nature of the crime. Considering the lack of evidence that could obscure, the defendant Delil İbrahim was released. The hearing was adjourned.
